Order and Notice – Attorneys Required to File All General Equity Pleadings (C Docket Cases) in eCourts as of December 1, 2024
Effective December 1, 2024, all New Jersey attorneys will be required to file all General Equity pleadings and other documents ("C" docket cases) using the Judiciary's eCourts system.
Mandatory Use of eCourts in General Equity
As noted in the October 1, 2024 notice to the bar, the Judiciary eCourts system now supports the filing of all pleadings and other documents in General Equity matters. The Supreme Court's November 12, 2024 Order requiring attorneys to file General Equity ("C" docket) pleadings and other documents electronically through eCourts as of December 1, 2024 is attached.
After that date, if an attorney files a General Equity document through the Judiciary Electronic Document Submission ("JEDS") system, the filing will be rejected by the clerk without a refund of the filing fee.
Guidance on how to file through eCourts is available on the Judiciary's eCourts Training webpage.
Reminder - Courtesy Copies
When electronically filing a motion, attorneys must simultaneously submit to the judge a paper courtesy copy of all motion-related papers, orders to show cause, and orders as required by Rule 1 :6-4 and the June 28, 2017 and October 25, 2022 notices to the bar. Attorneys must clearly indicate "COURTESY COPY" on the first page of each paper provided to the judge.
Questions regarding this notice may be directed to the AOC Civil Practice Division at (609) 815-2900 ext. 54900 or CivilWebSites.Mailbox@njcourts.gov.
The Court previously established eCourts and the Judiciary Electronic Document Submission ("JEDS") system as approved electronic filing systems for the trial divisions of the Superior Court and for the Tax Court pursuant to Rule 1 :32-2A(a) ("Authorization of Electronic Court Systems"). The Court in its May 5, 2020 Order required attorneys to file in eCourts where it is available, and in JEDS where it is not currently available, except that probate and guardianship documents shall continue to be filed with the County Surrogate. That Order further provided that where an attorney files a document in JEDS when eCourts is available, the filing will be rejected by the clerk without a refund of the filing fee.
The Judiciary has recently implemented eCourts for General Equity ("C" docket cases).
Accordingly, IT IS ORDERED that effective December 1, 2024, all New Jersey attorneys shall be required to file pleadings and other documents in General Equity cases in eCourts. After that date, if an attorney files a General Equity document in JEDS, the filing will be rejected by the clerk without a refund of the filing fee.
