This Directive promulgates for statewide use, “Dissolution (FM) Judgment for Name Change and Judgment for Name Change Addendum” (CN 13146). The form is necessary to ensure the confidentiality of Family Division name change records pursuant to Rule 1:38-3(f)(10).
Traditionally, the language granting a name change was included in the Judgment of Divorce (JOD). However, since JODs that do not contain information on custody, parenting time, or equitable distribution are open to the public, this new form and its addendum ensure compliance with confidentiality requirements. Its use also ensures compliance with N.J.S.A. 2A:52-2, which mandates the inclusion of the applicant’s Social Security number and date of birth in name change judgments.
The new form consists of two parts:
- Page 1: Judgment for Name Change – This page is the court order.
- Page 2: Judgment for Name Change Addendum – This page must include the party’s Social Security number and date of birth. It should be detached from page 1 when a party submits a name change request to an agency that does not require a Social Security number.
Parties must complete and file this form with the court when requesting a name change as part of:
- a Complaint or Counterclaim for Divorce, Dissolution, Termination, Annulment, or Separate Maintenance. This includes requests for a divorce without a court appearance (divorce on the papers); or
- an FM post-judgment motion.
